Welcome to the www.mobwits.com and www.mobsods.com web/wap sites (Sites). The Sites are operated by Grab A Gag Limited (GAG) (company number 5472663) whose registered office is The Brighton Media Centre, 15-17 Middle Street, Brighton, BN1 1AL.

These terms and conditions govern your use of each of the Sites (including but not limited to any text, graphics, illustrations, images, music or other information on those Sites), the viewing or accessing of any content (including but not limited to ringtones, greetings cards, games and graphics)(Content) and the use of any newsletter(s), emails or other communications (Newsletters) sent to you following registration on the Site. Please read these terms and conditions carefully.

These terms and conditions will, until varied (as set out below), govern all use by you of the Sites.

These terms and conditions are additional to and should be read in conjunction with the Privacy Policy.

Age Restrictions

www.mobsods.com contains material of an adult nature. You must be at least 18 years of age to access this Site and any Content (on this Site) and/or to receive any Newsletters from that Site.

GAG will try to ensure that www.mobwits.com does not contain any information of a purely adult or restricted nature. However, if you are under 18 you must obtain your parent/ guardian's permission before providing any personal information or registering with www.mobwits.com.

In consideration of GAG granting you access to a Site you agree to be bound by the terms and conditions set out below.

1. Use of a Site, Content and Newsletter

  1. Unless otherwise stated, all copyright (and all other rights of a like nature), neighbouring rights (including rights in performance), registered and unregistered design rights and trade marks and all other intellectual property rights (of whatever nature) (Rights) in the Sites, Newsletters and Content are owned by GAG, its licensors or any identified contributors.
  2. You are entitled to view the Content and Sites using your web browser or mobile device and you may save any screenshots or print out a copy of the Site or any Content for your own information, research or study purposes only. You may save a copy of the Newsletter on your PC for your future reference.
  3. You must not use any part of the Sites, Content or any part of a Newsletter for any commercial purpose unless approved in advance by the GAG.
  4. You may not download the whole or any part of the Content onto your PC, Mac or mobile device and you may not transmit or re-circulate any Content or the whole or any part of the Sites or any Newsletter to any person or entity except where expressly permitted to do so.
  5. You may not otherwise in anyway copy, reproduce, download, post, broadcast, edit, adapt or modify or otherwise use or exploit any part of the Content, Site or any Newsletter.
  6. All brand, product and service names used in the Sites are (unless otherwise stated) the trade marks, trade names or service marks of GAG or the parties to whom they refer. You may not distribute products or offer services under or by reference to or otherwise use or reproduce any such trade marks, trade names or service marks without the prior written permission of GAG or the owner of such trade marks, trade names or service marks.
  7. You must not attempt to interfere with the services provided by GAG, or try to gain unauthorised access to other sites, computers or networks connected to or via the Sites. In addition you will not add or remove any links to or from the Sites without the prior written consent of GAG.
  8. You will not use the whole or any part of the Sites, Content or Newsletters:
    1. to create a database (electronic or otherwise) which includes material downloaded or otherwise obtained from any of them;
    2. in such a way that might infringe third party rights or that might bring GAG into disrepute.

2. Third Party Rights

  1. Please note that some of the Content may contain impersonators of the celebrities. Where impersonators have been used this is made clear alongside the Content and you should be aware that such Content is not authorised by the individual(s) impersonated or parodied.
  2. Whilst GAG has made every effort to ensure that it does not infringe the rights of any individual or entity, if you consider that GAG has infringed your rights, please contact GAG by email at info@mobstarmedia.com, providing full details of the infringement you believe to have occurred. If after investigating your complaint, GAG is satisfied that it has infringed your rights it will remove such Content as soon as practical.

3. Site availability & Information on the Site

  1. Any information or any other materials on the Sites or in any Newsletter (including any Content, information or materials provided by any third party) has been included in good faith. No information on this Site or in any Newsletter should be relied upon for any specific purpose and no representation or warranty is given as to its accuracy or completeness save where the information provided forms the basis of a specific contract with you.
  2. As certain matters are outside of its control, GAG cannot guarantee that you will have uninterrupted access to the Sites at all times and GAG cannot guarantee that you will receive any Newsletter when sent.

4. Third Party Links and Information

  1. Any links provided on a Site are for your convenience. GAG does not endorse or take responsibility for the content of any linked web sites and is not responsible for the availability of those web sites. GAG will not be liable in any way for any loss or damage which you may suffer by using any of these web sites. If you decide to access any linked web sites you do so at your own risk and GAG encourages you to read the privacy statements and terms of use applicable to each specific site.
  2. The Sites may contain material (including, but not limited to, advertisements) posted by third parties. Individual users and advertisers are solely responsible for the content of advertising and other material which they submit to GAG and for ensuring that such content complies with all relevant legislation. GAG accepts no responsibility for the content of material submitted by third parties, including, without limitation, any error, omission or inaccuracy therein. If you believe that such material infringes any third party rights or does not comply with any legislation, please notify GAG by email at info@mobstarmedia.com, providing full details of the infringements you believe to have occurred. If after investigating your complaint, GAG is satisfied that such rights are infringed it will remove such material as soon as practical.

5. Right to Remove and Restrict Access

  1. GAG will be entitled at its discretion to remove any Content or any part of a Site or any information posted on a Site at any time. GAG shall also have the right to refuse to allow you access to any part of either Site at any time without giving you any advance notice if it believes you have or may breach these terms or any information you have provided is inaccurate.

6. Right to Terminate

  1. You may terminate ask to be removed from the mailing list for the Newsletter at any time by following the instructions on each Newsletter or other communication sent.
  2. If you wish to make any changes to the information you have provided then please amend your details on the Site if you are unable to change or update your details through the Site, please email GAG at info@mobstarmedia.com. Unless it would be unreasonable for GAG to do so, GAG will act on any requested changes.

7. Indemnity

  1. You hereby agree to fully indemnify and keep indemnified GAG against all liabilities, claims, actions, proceedings, loss, damage, costs or expenses suffered or incurred by GAG arising out of any use by you of the whole or any part of the Content, Sites or the Newsletters except as otherwise authorised.

8. Disclaimer of Warranties and Liability

  1. GAG will be liable to you for any losses or damages you suffer as a result of a breach by GAG of these terms and conditions where those losses were reasonably foreseeable to both you and GAG at the date you access the Site. GAG will not be responsible for any business or economic losses (including but not limited to loss of profit, revenue, contracts, anticipated savings or opportunity) or any other indirect loss that is not reasonably foreseeable to both GAG and you at that time.
  2. Whilst effort has been taken to ensure that the Sites are free from viruses, no warranties are given that they are free from viruses and users are responsible for ensuring that they have installed adequate virus checking software. GAG shall not be liable for any viruses or any other computer code, files or programs designed to interrupt, restrict, destroy, limit the functionality of or compromise the integrity of the Sites or any hardware on which it is hosted unless such viruses has been included on the Site or in any Newsletter by GAG's negligence or by a deliberate act of GAG.
  3. Nothing in these terms and conditions will exclude GAG's liability in the case of death or personal injury caused by its negligence, breach of statutory duty or any wilful act (where its liability is unlimited).
  4. These Sites may be accessed throughout the UK and overseas. GAG makes no representation that the Content or the Newsletter (or any part of it) complies with the laws (including any Rights) of any country outside the UK. If you access this Site, any Content or Newsletter from outside the UK you do so at your own risk and are responsible for the compliance with any laws in the country in which you are located.

9. Purchase through the Site

  1. If you make any purchases through the Sites, you will, in addition, be subject to the then current conditions of sale that apply to all such purchases (Conditions of Sale). You will be asked to confirm your agreement to the Conditions of Sale prior to completing any purchases.

10. Variations

  1. These terms may be varied from time to time. Please ensure that you review these terms regularly. Your continued use of either Site after a change in these terms will be deemed acceptance of those changes.

11. Entire Agreement

  1. Except where we agree or notify you otherwise, these terms and conditions contain the entire agreement between GAG and you in relation to your access to and use of a Site.

12. Governing Law

  1. These terms and conditions are governed by and interpreted in accordance with the laws of England and Wales. Any disputes arising under or in connection with these terms and conditions shall be subject to the non-exclusive jurisdiction of the English Courts.
